1. Services
American Crop Recovery LLC ("ACR") provides USDA disaster assistance program consulting services, including application preparation, filing support, tracking, appeals representation, farm mapping, document organization, eligibility review, and related agricultural program support.
2. No Recovery, No Fee
ACR may operate on a contingency basis when specified in an individual service agreement. Any service fee, percentage, billing terms, and payment timing are governed by the signed agreement between ACR and the client.
3. Client Responsibilities
As a client, you agree to provide accurate and truthful information about your farming operation, supply requested documentation in a timely manner, sign necessary authorization forms, notify ACR of material changes, and avoid filing duplicate or conflicting applications for the same program unless coordinated with ACR.
4. Authorization
When you engage ACR and sign the required authorizations, you authorize ACR to communicate with USDA offices and submit documentation as permitted by those authorizations and your service agreement.
5. No Guarantee
ACR uses its expertise to support eligible recovery efforts, but cannot guarantee specific payment amounts, approval of any application, agency timelines, program availability, or outcomes. USDA and related agency decisions are subject to program rules, funding availability, eligibility requirements, and agency discretion.
6. Website and SMS Use
You agree not to misuse the website, SMS consent form, contact forms, or client portal; submit false information; interfere with site security; or attempt unauthorized access. SMS consent is not a condition of purchase. Message frequency may vary. Message and data rates may apply. Reply STOP to opt out and HELP for assistance.
7. Intellectual Property
All content, branding, trade names, designs, materials, and proprietary tools on the ACR website and platform are owned by American Crop Recovery LLC or its licensors. You may not reproduce, distribute, or create derivative works from our materials without written permission.
8. Limitation of Liability
To the maximum extent permitted by law, ACR is not liable for USDA decisions, program changes, funding shortfalls, delays outside our control, unauthorized third-party actions, or indirect or consequential damages. Any liability is limited by the applicable written agreement and law.
9. Changes to These Terms
We may update these terms from time to time. Continued use of the website or services after updates means you accept the revised terms, subject to any separately signed agreement.
